Mayor & Council,
I am writing to you, in the hopes of informing you of the grievous error of your intention to disarm law-abiding citizens of their right keep & bear arms. State law in Alabama allows for any person who is a danger to their self or others to be disarmed. There is no need for further regulation. While your intention may not be to disarm the public at large, your legislation opens the possibilty to future adminstrators who may not have the same sensibilities. Plus, your proposed laws are already illegal & unconstitutional.
There are two laws which I would like to cite in my grievance:
1) Amendment 2 of the United States Constitution. Whereas “the right of the people to keep and bear arms shall not be infringed.”
If the US Constitution doesn’t work for you, try
2)The Robert T Stafford Disaster Relief & Emergency Assistance Act, also recorded as amended – 42 USC 5207, whereas:
Sec. 706. Firearms Policies (42 U.S.C. 5207)*
(a) Prohibition on Confiscation of Firearms – No officer or employee of the United
States (including any member of the uniformed services), or person operating
pursuant to or under color of Federal law, or receiving Federal funds, or under
control of any Federal official, or providing services to such an officer,
(1) temporarily or permanently seize, or authorize seizure of, any firearm the
possession of which is not prohibited under Federal, State, or local law,
other than for forfeiture in compliance with Federal law or as evidence in a
(2) require registration of any firearm for which registration is not required by
Federal, State, or local law;
(3) prohibit possession of any firearm, or promulgate any rule, regulation, or
order prohibiting possession of any firearm, in any place or by any person
where such possession is not otherwise prohibited by Federal, State, or
local law; or
(4) prohibit the carrying of firearms under Federal, State, or local law, solely
because such person is operating under the direction, control, or supervision
of a Federal agency in support of relief from the major disaster or
(b) Limitation – Nothing in this section shall be construed to prohibit any person in
subsection (a) from requiring the temporary surrender of a firearm as a
condition for entry into any mode of transportation used for rescue or
evacuation during a major disaster or emergency, provided that such
temporarily surrendered firearm is returned at the completion of such rescue or
As illustrated, you do not have the authority to disarm your citizens, under any emergency circumstances. Any disaster which you may presume grand enough to enable your tyrannical lusts, should be declared thus, by federal authorities.
Federal law clearly takes precendence in such a case and subordinates your authority to federal regulators who have made it abundantly clear, that your citizens are NOT to be disarmed.
That you would even desire to disarm your citizens at a time when emergency services are strained, resources are stretched, and opportunists most likely to take advantage of an already bad situation is disgusting and flies in the face of everything this nation was founded upon.
I have copied this letter to various contacts, I have posted it to the website for which I am a writer, in the cause of individual liberty (and against tyranny), and will further disseminate your tyrannical aspirations through exploitation of all means available via social media sites.
I have also written a letter to the editor of the local paper, the Advertiser-Gleam. Please, conduct yourselves appropriately.
To all of our readers, please feel free to contact the would-be tyrants noted above, and let them know what you think of their proposed legislation:
